Helping You Get Spousal Support Right

Free 30-Minute Consultations Schedule Your Appointment

Spousal support is a payment from one spouse to the other when a marriage ends. Where parties are not married, such support may still be payable but it is called "adult interdependent partner support". The primary purpose of such support is to ensure that the person who earns less is financially assisted by the person who earns more so as to maintain, as much as possible, a standard of living that was set during the relationship.

Unlike child support guidelines, which have been codified and therefore are binding law, spousal support guidelines are just that - guidelines. In determining how much support is payable, certain factors - such as the length of the relationship, the roles played in the relationship and whether or not individual career paths were affected - are considered. That makes working with a knowledgeable lawyer who can protect your interests an important aspect in divorce and separation.

Protecting Your Interests In Spousal Support and Adult Interdependent Support Matters

At Byron & Company, in Fort McMurray, we help our clients reach a fair support agreement that protects their financial foundation. We work to reach an agreement without the need to litigate. This saves legal costs and allows both parties to retain more control over the decisions that are reached. If a fair agreement cannot be reached through negotiation, we are always prepared to advocate on our client's behalf in court.

Canadian courts consider a number of factors when setting the amount of support, including:

  • The length of the marriage
  • Both parties' assets
  • Both parties' income and earning ability
  • The age and health of both parties
  • The standard of living that was set before the marriage ended
  • Any education or retraining that one party must complete in order to become more self-sufficient
  • Any contributions one spouse made to further the other spouse's career, including caring for children
