We counsel clients in all aspects of family law, including:

  • Divorce — In cases where adultery and physical and/or mental cruelty are not grounds for divorce, Federal law requires married couples to be separated for a minimum of one year before getting divorced.
  • Division of property — Property law falls under the purvue of Provincial jurisdiction and Alberta's Matrimonial Property Act requires the equal distribution of matrimonial property. There are, however, some exceptions and an experienced lawyer will help determine if your matter involves an exception. The law concerning the division of property in common law relationships is different and does not necessitate the equal distribution of property; rather, it is based on contributions made. An experienced lawyer knowledgeable in the area of property distribution is essential.
  • Custody and access of children — This determines how parental time is divided, where children will spend their days and nights and rights regarding guardianship.
  • Child support — A parent who provides more care than the other will typically receive financial support from the other parent.
  • Spousal support — One spouse may be required to provide financial support to the other to help maintain a standard of living that was set during the relationship, while the recipient takes steps to become more self-sufficient.
  • Family law agreements — We prepare separation agreements, divorce consent orders and prenuptial/marriage and cohabitation agreements.
